Jobkeeper Assistance Procedure

As we all try to negotiate the ever changing circumstances under Covid19 conditions and in Governments Jobkeeper Assistance, below is a summary of the requirements and the steps that are required to be taken. Note, that this is a general guide to cover all the possible business structures that exists and may not entirely be appropriate for your circumstances. Please enquire should you require clarification or additional information for your particular business.

Businesses that employ workers:

  • Determine your Eligible Employees under Jobkeeper. ATO link to all the criteria is: https://www.ato.gov.au/General/JobKeeper-Payment/Employers/Your-eligible-employees/
  • The main criteria are: re employed by you (including those stood down or re-hired)
    • were either a
    • permanent full-time or part-time employee at 1 March 2020
    • long-term casual employee (employed on a regular and systematic basis for at least 12 months) as at 1 March 2020 and not a permanent employee of any other employer
  • Employee Nomination Notice MUST be completed and signed by the employee and MUST be retained by you, the employer, for 5 years. Notice is attached in the email and in addition the link is https://www.ato.gov.au/Forms/JobKeeper-payment—employee-nomination-notice/. Note that the employee has a requirement to select you, the employer as the Nominated Employer for Jobkeeper. If they do not select you then you are not entitled to the Jobkeeper for that employee.
  • You must pay the minimum $1,500 per fortnight, or the equivalent based on your pay cycle. In particular, if you pay monthly, the gross pay is would be $3,250 per month.
  • If an employee is already receiving more than the equivalent$1,500 per fortnight, then you do not need to do anything different.
  • Superannuation is only payable on the employee’s normal wage. If you are having to “top up” the employee’s wage to meet the minimum $1,500 per fortnight, then you do not have to pay superannuation on that part of the pay. You may choose to pay superannuation on it but you don’t need to. You must ensure that the wages are processed correctly through your Payroll Software so that the correct information is reported to the ATO under Single Touch Payroll.
  • You must Enrol in the Jobkeeper. This is done through the Business Portal. If you do not have access to the Business Portal and would like us to enrol on your behalf, then you must supply the following the information by 26 April 2020 – by return email:
    • Number of Eligible Employees
    • The Month that you first expect a 30% or more reduction in your Business income, to the comparable month 12 months earlier
    • If you are nominating a Business Participant (see below for further details)
    • Business bank account details :
      • Account name
      • BSB
      • Account number
    • Contact details:
      • Your name
      • Phone number
      • Email address

 

Business Owners that operate through a Partnership, Trust or Company:

  • The Jobkeeper is available for ONLY ONE person connected to the business – known as the Business Participant
  • If you believe your business will meet the criteria to access the Jobkeeper payment – ie a 30% or more reduction in your business income – then you need to nominate the person
  • Complete and Retain (for 5 years) the Jobkeeper Nomination form for Business Participants. The form is attached and in addition the link is https://www.ato.gov.au/Forms/JobKeeper-nomination-notice-for-eligible-business-participants—excluding-sole-traders/
  • Note this DOES NOT apply for Sole Traders
  • Sole Traders, need to:
    • Enrol through your ATO Business Portal
    • If you do not have access the ATO Business Portal and wish us to Enrol on your behalf, please email your request to us. You will need to supply the following information:
      • Month that you first expect a reduction of 30% or more in your business income, to the comparable month 12 months earlier
      • Business bank account details:
        • Account name
        • BSB
        • Account number
      • Contact details:
        • Your name
        • Phone number
        • Email address

 

In some circumstances, we may have already discussed this with you and enacted the steps involved. If any doubt, please confirm.

From this point, the next step will be lodging your Business Income with the ATO, to prove your eligibility for the Jobkeeper payment. This will be available to be done from 4th May 2020.

You are able to lodge this information by logging into your ATO Business Portal. If you do not have access to the ATO Business Portal and would like us to lodge the information on your behalf, then you will need to supply the following information:

  • Month that you are reporting on
  • Business income for that month
  • Business income for the comparable month 12 months earlier
  • Expected income for the following month

You need to do this by email and NOT BEFORE 4th May, and then every month there after.
